FUNCTION OF WORK:
To independently serve as the legal counsel for a major department with multiple complex programs over a geographic area of an agency (generally 3 to 10 regions) when positions are geographically removed from their boss.

LEVEL OF WORK:
Program Manager

SUPERVISION RECEIVED:
Broad direction from an Attorney--General Counsel 3 or Attorney--Deputy Counsel 2 or equivalent level unclassified position.

SUPERVISION EXERCISED:
May exercise direct supervision over one subordinate attorney or other support staff.

JOB DISTINCTIONS:
Differs from lower level Attorney jobs by the presence of independent responsibility for legal activities of a region for a major state agency with multiple complex legal programs as well as the nature of the reporting relationship. Positions allocated to this title are physically remote from their immediate supervisor (e.g. Reporting to an Attorney--General Counsel 3 or Attorney--Deputy General Counsel 2.)

Differs from Attorney Supervisor by the absence of direct supervisory responsibility over a minimum of two Attorney positions.

Serves as chief regional legal counsel for a major state department, with multiple program offices, in an assigned geographic region, and is responsible for independently providing highly technical legal direction, advice, assistance, consultation, representation and having a direct influence on the operations of the Regional Program Offices and/or 24-hour facilities operated by the department in the assigned region. Responsible for maintaining a broad and intensive legal experience in all phases of the legal process sufficient to support a mastery in the specialized legal matters affecting a major state department.

Directs and coordinates the operations of a Regional Legal Office including establishing, coordinating, implementing and monitoring policies and procedures in order to ensure compliance with all laws regarding a department with multiple program offices.

Serves as liaison between department, other governmental agencies and the judiciary within the region. Interacts with other state agencies, including the handling of conflicts between the Regional Program Offices and engages in decision making for the program offices.

Represents a department with multiple program offices in conflicts arising between the department and private contract providers.

Drafts, reviews and approves policies for Regional Program Offices and/or 24-hour facilities located within the assigned region.

Represents a department with multiple program offices when confronted with emergency orders from the judiciary in the assigned region.

Provides consultation, representation and recommendations within assigned region to all agency offices.

Drafts, reviews and approves contracts and legal documents and issues legal opinions pertaining to the multiple program offices within the assigned region.

Represents a department in complex litigation before tribunals at the local level (juvenile court), state level (juvenile, civil, appellate courts in multiple parishes and the State Supreme Court), administrative tribunals (Civil Service Commission and the Division of Administrative Law), and the federal level. May litigate cases involving the department in surrounding states as licensed.

Represents or assists other legal sections with the preparation and litigation of numerous matters that are located within the assigned regional area. Provides relief coverage and litigates matters for other Regional Attorneys.

Advises the judiciary in the multiple parishes of assigned region regarding the complex laws and legal matters, in which the Regional Attorney has specialized, whether the department is a party to the dispute or whether the matter is limited in scope between law enforcement and an individual.

Serves as counsel, or co-counsel, to defend the agency in suits seeking money damages against the department, Regional Program Offices, agency officials and personnel.

Prepares emergency orders for the enforcement of department's policies or administrative laws and may seek injunctive court orders when necessary.

Makes recommendations regarding the impact of state laws in the assigned region and drafts legislation to correct deficiencies in the law as it pertains to services provided by the multiple programs of the department.

Provides training on legal issues affecting the multiple programs of the department to the administrative staff and agency personnel within the assigned region, including personnel at 24-hour facilities which do not otherwise fall under the Regional Program Offices.

Advises department officials in multiple program offices on legal issues.

Provides legal assistance and guidance in matters pertaining to public records requests and files the necessary objections.

Makes public appearances and presentations on behalf of the agency as requested by agency management and/or the judiciary.

Serves on, and may chair, department Regional Coordinating Committee.

Provides guidance and assistance to attorneys of lower rank.

QUALIFICATION REQUIREMENTS:
MINIMUM QUALIFICATIONS:
Possession of a current Louisiana license to practice law plus four years of experience as a practicing attorney.
