FUNCTION OF WORK:
To conduct evidentiary hearings and render decisions on appealed issues.

Experienced

SUPERVISION RECEIVED:
General from Administrative Law Judge--Advanced or other higher level official.

SUPERVISION EXERCISED:
May exercise functional supervision over Administrative Law Judge--Entry.

JOB DISTINCTIONS:
Differs from Administrative Law Judge--Entry by the journeyman level of work.

Differs from Administrative Law Judge--Advanced by the subordinate relationship and lesser independence of action.

Schedules and conducts due process and evidentiary hearings as defined by federal law or regulation.

Prepares for hearings by reading cases, appeals, rulings, documents, files, and investigation reports.

Arranges for the appearance of witnesses, issuing subpoenas when necessary.

Advises parties as to their rights, swears in and examines witnesses, hears arguments, and receives evidence.

Evaluates facts, evidence, and law; appraises briefs and analyzes pleadings.

Prepares reports summarizing testimony and evidence; enters report into record for decision by higher authority.

Appears in court to testify on cases adjudicated.

Examines relevant and material evidence and legal and administrative documents, rules on admissibility of evidence, interrogates witnesses and parties as the case requires, submits objections and exceptions, resolves procedural questions, and grants or denies postponements and continuances.

Reviews and considers testimony in detail, determines credibility and weight of evidence in making findings of fact, applies facts to the law, interprets the law, and draws conclusions.

Researches laws, agency policies and interpretations, and other decisions in preparing final decision.

Drafts formal written decisions or orders setting forth facts and reasons for the decision, the applicable law, and the decision reached; distributes to interested parties.

Makes a complete record of the proceeding to include therein all relevant and material matters, including exhibits necessary for a review on appeal.

Conducts continuous study of current decisions, rulings, and amendments.

QUALIFICATION REQUIREMENTS:
MINIMUM QUALIFICATIONS:
One year of experience in conducting hearings in a field related to the law being adjudicated, or as a current licensed practicing attorney, plus one of the following:

A bachelor's degree plus two years of experience in a field related to the law being adjudicated; OR

A Juris Doctorate plus one year of experience in a field related to the law being adjudicated; OR

Possession of a license to practice law in the state of Louisiana.
