FUNCTION OF WORK:To prosecute all alleged violators of Alcohol and Tobacco Control Law and Statutory Criminal Law and perform all activities necessary for the conduct of administrative hearings related to such violations.

JOB DISTINCTIONS:Differs from Alcohol Tobacco Control Agents by the presence of responsibility for prosecuting alleged violators of the Alcohol and Tobacco Control Law and Statutory Criminal Law.
Differs from Alcohol Tobacco Control Deputy Commissioner by the absence of full administrative responsibility for both the enforcement and certification programs.

Serves as prosecutor of alleged violators of Title 26, Louisiana Alcohol and Tobacco Control Laws with which all alcoholic beverage and tobacco outlets must comply.
Receives from state, local, federal investigators and various law enforcement officials complaints, reports, citations, and evidence relative to alleged violations of Title 26 and evaluates all data to determine whether prosecution is appropriate.
Performs statistical analysis on each alleged violation to assist in determining the extent and severity of each.
Confers with the field supervisor on complaints and advises him as to the proper follow-up action, such as to take no action or to verify the validity of the complaint through further investigation.
Responds to complaints, prepares warning letter or fine assessment letters and forwards them to the permitted involved.
Organizes and conducts formal hearings which entails preparing all legal documents, gathering submitted evidence, arranging for the appearance of witnesses, issuing subpoenas, and presenting the case before the Alcohol Tobacco Control Deputy Commissioner or unclassified Commissioner.
Interrogates witnesses during the administrative hearings to determine findings of fact and clarifies all aspects of case which often requires submission of evidence.
Accounts for all evidence seized, confiscated, and submitted as the result of an investigation.
Prepares, after determination by the Alcohol Tobacco Control Deputy Commissioner or unclassified Commissioner, a formal written decision setting forth findings of facts and reasons for the decision, the applicable laws, and the decision reached.
Compiles data from public hearings and makes legislative and rule making recommendations to the Alcohol Tobacco Control Deputy Commissioner.
Answers questions from attorneys, permittees, and various law enforcement officials.
QUALIFICATION REQUIREMENTS:MINIMUM QUALIFICATIONS:
Four years of administrative services experience; OR
Six years of full-time work experience plus one year of administrative services experience; OR
A bachelor's degree plus one year of administrative services experience.
EXPERIENCE SUBSTITUTION:
Every 30 semester hours earned from an accredited college or university will be credited as one year of experience towards the six years of full-time work experience in any field. The maximum substitution allowed is 120 semester hours which substitutes for a maximum of four years of experience in any field.
